ELIGIBILITY
The theta360.guide Future of Construction Technology Ideas Contest (the “Promotion”) is open to people who are at least eighteen (18) years at the time of entry. You can not be a resident of Cuba, Iran, North Korea, Sudan, or Syria. US export regulations prohibit the export of goods and services to the countries listed above, therefore residents of these countries are not eligible to participate in this challenge. Subject to all applicable federal, state and local laws and regulations. Void where prohibited by law. Participation constitutes entrant’s agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to this Promotion. The Promotion is a contest.
TIMING
Promotion starts on Monday, December 9, 2019, 10:00am PT, and ends Tuesday, January 14, 2020, 11:59pm PT (“midnight”), with the final winner announced Tuesday, January 21, 2020. The computers and processes of Sponsor (as determined in Sponsor’s sole discretion) shall be the official timekeepers of this Promotion.

HOW TO ENTER
During the Promotion period, go to and enter your username and email address pursuant to the on-screen instructions. https://theta360.guide/special/construction/ Registration with the site is required along with responses to 5 questions and submission of your idea. Upon successful completion, you will automatically receive one (1) entry into this Promotion.
Limit
Each participant may submit one (1) entry during the Promotion period. Multiple entries are not allowed, and an attempt by an entrant to obtain more than the stated number of entries by using multiple/different email addresses will void all of that entrant’s entry.
Once entered, the participant will be included in following giveaway, unless selected as a winner.
WINNER SELECTION AND ODDS OF WINNING
One (1) winner will be selected from among all eligible online entries received by the Contest deadline. Judging will be conducted by the Sponsor whose decisions are final. Winner is subject to verification before any prize will be awarded. Winner will be notified via email, at Sponsor’s discretion, with up to three emails to the email address included on the signup form. If the winner does not reply by “reply deadline” stated in the emails, another winner will be selected with 5 days to reply.
WINNER VERIFICATION
Winners must comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. Winners will be notified email after the date of the random drawing. If a winner cannot be contacted within the required time period, the winner forfeits the prize. In the event of such forfeiture or disqualification for any other reason, Sponsor reserves the right to award the prize to an alternate winner from among all remaining eligible entries. There will be a maximum of one (1) alternate winner, after which the prize will remain unawarded. Prizes will be fulfilled 8-10 weeks after winners are confirmed.
PRIZES
Winner will receive one (1) RICOH THETA V (approximate retail value on Amazon is $344.50)
For all prizes
No cash equivalent. Prizes are non-transferable and no substitution will be made except at Sponsor’s sole discretion or in the event a prize is unavailable. If a prize is unavailable, Sponsor reserves the right to substitute any listed prize for one of equal or greater value. All prize details not specifically detailed in the Official Rules such as color, size and any additional features will be selected in Sponsor’s sole discretion. Winners are responsible for all taxes and fees associated with the prize receipt. Prizes are awarded “AS IS.” Neither Sponsor nor Sponsor Affiliates make or offer any warranty or guarantee, either express or implied (including, without limitation, quality, merchantability and fitness for a particular purpose) in connection with the Promotion or any prize. No issuer of any offered prize is associated with or sponsoring the Promotion.
RELEASE OF LIABILITY; DISCLAIMER OF RESPONSIBILITY
By accepting a prize, winners agree to hold Sponsor, its advertising and promotion agency and their respective affiliated companies, partners, representative agents, successors, assigns, officers, directors, and employees (collectively, the “Released Parties”) harmless for any injury or damage caused or claimed to be caused by participation in any Promotion or acceptance or use of the prize. Sponsor is not responsible for any printing, typographical, mechanical or other error in the printing of the offer, administration of any Promotion or in the announcement of the prize(s) in a particular Promotion. Sponsor assumes no responsibility or liability for (a) an error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; (b) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; © any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in a Promotion or downloading any materials in a Promotion; (d) technical or human error which may occur in the processing of entries; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in any Promotion or receipt or use or misuse of a prize.
INTERNET
Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operation or transmission, theft or destruction or unauthorized access to or alteration of entry material, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at a website or any combination thereof. Sponsor reserves the right at its discretion to cancel, terminate, modify or suspend any Promotion if it is not capable of being operated as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond Sponsor’s control which corrupt or affect the administration, security, fairness, integrity or proper conduct of such Promotion. In such event, Sponsor may award prizes in a random drawing from all eligible entries received up to the date of cancellation or suspension. Sponsor reserve the right to disqualify any individual from participating in a Promotion or winning a prize if, in its sole discretion, it determines that said individual is attempting to undermine the legitimate operation of a Promotion by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs or intending to annoy, abuse or threaten any other entrants or Sponsor representatives).
ANY ATTEMPT BY AN ENTRANT DELIBERATELY TO UNDERMINE THE LEGITIMATE OPERATION OF ANY PROMOTION OR DAMAGE THE https://theta360.guide/special/construction/ WEBSITE MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULL EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
PRIVACY
Any information you submit will be subject to Sponsor’s Privacy Policy, located at https://community.theta360.guide/privacy (the “Policy”). By entering any Promotion, you acknowledge your agreement to such Policy and your consent to Sponsor’s collection, use and disclosure of your personal information for the purposes of administering the Promotion(s) in which you are participating in accordance with such Policy. DISPUTE/CHOICE OF LAW
Except where prohibited, each entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with any Promotion or any prize(s) awarded shall be resolved individually, without resort to a form of class action, and exclusively in the courts located in the county of San Francisco, California, or the U.S. District Court for the Northern District of California, (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorney’s fees; and © no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, “Special Damages”), and (d) entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. California State law, without reference to California’s choice of law rules, governs each Promotion and all aspects related thereto.
